NAIROBI,Kenya, May, 22 – Days after American businessman Mohamud Bashir Mohammed was reported missing and his vehicle found burnt In Ngong Forest sparking concerns over his safety, his family despite initially fearing the worst now believe he is being held against his will by police.
The businessman’s family now believe he is being held incommunicado at an undisclosed location in “gross violation of his human rights.”
In an application filed at the Kajiado Law Courts, the family is now demanding his immediate release from police custody.
“We now believe he was arrested by police” said the businessman’s brother Abdifatah Mohamed Mohamud.
Basher was last spotted in public on May 13 leaving a popular Lounge and restaurant in Lavington.
His movements were captured on CCTV camera.
“The police officers under the direction and command of the respondents carried out an
arbitrary arrest commando style and without any legal and moral consideration carried out
unwarranted, intrusive, abusive and demeaning arrest,” he said.
Despite attempts to get the investigating agency’s attention on the matter, the family say they are making little progress in establishing his whereabouts.
In the habeas corpus application,Interior Cabinet Secretary Dr Fred Matiang’i, the Inspector General of Police, Director of Public Prosecution, OCS Oloolua Police Station and OCS Muthangari Police Station have been listed as respondents.
The United States of America have also been accused of being, “non-committal ” considering the businessman holds an American citizenship.
“Why are we not being told why he was arrested?” posed Bashir’s brother citing unwillingness by officers commanding stations in Oloolua and Muthangari Police Station.
The American businessman is said to have been undertaking a multimillion shilling construction project at the Kibuye Market in Kisumu.
Deputy Inspector General of police Edward Mbugua told the National Assembly Committee on Administration and Security that investigations commenced immediately a missing person report was made at Muthangari Police Station.
“I would however have to call the DCI and inquire on where investigations have reached,” said Kenya Police Service boss said.
According to preliminary reports, Bashir had attempted to call his wife who had just given birth a few days earlier.
