    Driver of matatu that killed DIG Mbugua’s daughter released on Sh 300,000 cash bail

    NAIROBI,Kenya, June 24 – Patrick Magu, the driver of the matatu that killed Deputy Inspector General of Police Edward Mbugua’s daughter has been charged with driving an unroadworthy motor vehicle contrary to section 55 (1) as read with section 58 (1) of the traffic act Laws of Kenya.

    Appearing before Milimani Law Courts magistrate Esther Kimilu, the accused is further said to have ben operating a  vehicle while some parts and equipment were not properly maintained as a result endangering the lives of passengers and pedestrians..

    Particulars of the offense further indicate that upon inspection of the vehicle, it had among others: a defective digital speed governor, a functionless reverse lights, lacked a valid inspection sticker, had three tinted windows and a dented rear right wing.

    The accused who pleaded not guilty was released on a Sh 300,000 cash bail or bond of Sh 600,000.

    Patrick Magu was arrested on June 17,  following the incident that occurred within Nairobi’s Central Business District (CBD).

    “That at the time of the offence, the suspect was the driver of motor vehicle KBR 065B make Isuzu minibus operated by KMO Sacco along the junction of Tom Mboya street and Maragua lane where he reversed the motor vehicle dangerously without due care to other road users and sandwiched a pedestrian by the name Nelly Waithera aged 25 years between another motor vehicle KBL 744A,” reads a section of the police affidavit seen by Shahidi News.

    The Investigating Officer, Inspector Peter Ndirangu told Milimani Magistrate Esther Kimilu that the victim sustained serious injuries and was rushed to Kenyatta National Hospital where she succumbed to injuries while undergoing treatment.

    The driver, after realizing his mistakes, police said that he abandoned the motor vehicle to avoid arrest.

    He was traced along the University Way and arrested.

    Waithera was crossing on foot on June 17 at 8am from Tom Mboya Street when the incident happened.
