NAIROBI,Kenya, July 6 – Dickson Mararo, the main suspect in the shooting of two police officers and a woman at an entertainment joint along Thika Road has been remanded to the Muthaiga police station awaiting a ruling Wednesday (tomorrow) on whether he will be detained pending further investigations.
The prosecution led by Eveline Onunga filed an application seeking 14 days to detain the suspect.
“The suspect has not been processed, three people were injured, they sustained gunshots wounds and one is critically ill. We are seeking these orders because the investigating officer (Geoffrey Ndatho) is investigating a case of attempted murder contrary to section 220b of the penal code, ” said Onunga.
Mararo presented himself to the DCI headquarters along Kiambu road alongside his lawyer Cliff Ombeta after evading police capture for two days.
“We are seeking time to allow the victim identify the suspect. The incident happened at night at the club. The moment the suspect will be arraigned and charged with the offense, the victims will have knowledge of the suspects and this will bring about objection of having know the suspect prior.” said Onunga.
Appearing before Principa Magistrate Zainab Abdul, the prosecution further argued that the victim statements have not been recorded by the virtue that they are still admitted in the hospital further saying, “We consider compelling,we persuade this court to give us the days sought. It is our prayer your grant us these days. We will be able to conclude investigations.”
Lawyer Dan Maanzo representing Festus Musyoka, a DCI officer attached at Starehe division, said his client is still undergoing several operations at the Nairobi hospital.
“My client is undergoing a13 hour operation, which required quite a number of expert including surgeons, neuro-surgeons and specialists of shattered bones around the neck and shoulder area. His health status is not ascertained because as of Tuesday morning he had not woken up, so considering the charge of attempted murder or if he recovers grievous bodily harm it would be of importance that the suspect is detained so that we could have enough time to know which way the prosecution will go,” said Maanzo.
The suspect’s lawyer Cliff Ombeta meanwhile opposed the application saying that the investigations commenced on July 2,2021.
“when they say the suspect ran away from the scene, how does the have a bearing on this matter because the same suspect we are told presented himself by counsel or presented before them, is that reason to hold him today? We are told he has not been processed, that is not true, they took his finger prints and photographs in my presence,” said Ombeta
The victims were identified as Festus Musyoka, a police constable attached at the Starehe DCI offices while the second one was identified as Lawrence Muturi, a police constable attached at the petty crime unit at Kasarani police station.
The third victim was identified as Felictas Nzisa.
Constable Musyoka was shot on the left side of his neck, constable Muturi was reportedly shot on the hand while Nzisa was shot on the abdomen.
CCTV footage showed the gunman fleeing the scene and subsequently the premises aboard his vehicle.
