NAIROBI, Kenya, Jul 13- The Law Society of Kenya (LSK) President Nelson Havi has been arrested.

Havi was picked up from his office by detectives over claims that he assaulted the society Chief Executive Officer Mercy Wambua on Monday.

He was arrested at his office in Westland and taken to the Directorate of Criminal Investigations headquarters, located along Kiambu Road.

“He was at his office when he was arrested,” LSK Vice-President Carolyne Kamende said.

The DCI has since taken over the investigations, after Wambua made a report at the Muthangari police station.

What do we know about the incident?

The incident is said to have occurred during a scuffle at the LSK Gatanga road-based offices and was reported to police in Muthangari under OB34/12/7/2021.

Wambua told police that she was hurt in “her right arm and finger.”

According to her statement, the council had convened a meeting without her knowledge, despite being the society’s secretary.

But upon entering the venue, Wambua said she was dismissed as a stranger and asked to leave. She declined.

“He was there with legitimate council members allied to him as well as a team calling themselves caretaker members. Other legitimate council members joined online,” she said.

Adamant that she would not leave the meeting, Wambua said she sat down and opened her laptop.

It is at this point she alleged that the LSK President stood up and charged at her, slamming her laptop shut and then proceeded to push her.

“I was assaulted during the embarrassing incident. This is wrong,” she said. In the melee, she said, she had her arm and finger injured.

Wambua added that, ” I have also filled the P3 form for further police action.”

Havi however denied the allegations saying Wambua sought to interrupt the meeting and further proceeded to hold an online meeting.

“I closed her laptop, opened the door where after she stood up and left, on her way out she said she had been hurt and was going to report to the police station,” Havi said.

Wambua and Havi have had a long running tussle. This was after Havi declared her sacked in October last year.

He claimed that Wambua was part of the team that had allegedly embezzled the society’s money. The council later reinstated her.

Theft is theft! It is no less if committed by a woman. Mercy Wambua is shielding her principals, two immediate former Presidents of LSK from liability for plunder of hundreds of millions. Falsely shouting through paid journalists that ‘Nelson Havi assaulted me’ won’t help. ^POLSK

Orange Democratic Movement Secretary General Edwin Sifuna had earlier asked the DCI to move in with speed and investigate the incident.

Edwin Sifuna, if I was violent, wewe ungefinywa on 18-1-2021. Acha ujinga ndugu! No amount of drama will detract us from pursuing the theft of members’ money by your OKOALSK team! https://t.co/xB5gRXgx9N

Lawyer Miguna Miguna has however asked Havi not to be ‘intimidated’. Havi has had a tough stance on government and is among vocal lawyers against the Building Bridges Initiative (BBI).

To @NelsonHavi: Never, ever, be intimidated by desperate attempts of the Impunity Merchants. They have already lost. The Majestic People of Kenya know that you are on their side and the Impunity Merchants are their enemies. Whatever they do will not succeed. Let's remain focused!
