NAIROBI,Kenya, Oct, 15 – Inspector of Police Philip Mbithi, Police Constable Kamakia Mutuma Boniface and Police Constable Precious Mwende Mwinziall attached at the Jogoo Road Police Station have been released on Sh100,000 each a day after being arrested for allegedly aiding the escape of suspected children serial killer Masten Wanjala from his Jogoo Road police Station Cell.
Appearing before Milimani Senior Resident Magistrate Jane Kamau, the three will however as part of the release be expected to present themselves before the investigating officers daily for the next seven days.
They are to report at their offices at 9:30am.
In the defence the three suspects had itnially through their Lawyer faulted a power blackout as the reason the suspect escaped from detention.
“The state must employ all machinery to investigate this matter including the Independent Policing Oversight Authority. Police must act with speed to bring this matter to an end,” Ruled Kamau.
The court further directed that investigations on the matter be completed within seven days upon which a decision whether or not to charge them will be announced.
Investigating Officers probing the suspicious escape from jail by the suspected children serial killer had Thursday filed an application seeking to detain the three police officers for 14 days in order to allow further investigations.
In the application, the officers are accused of aiding a prisoner (Masten Wanjala) to escape contrary of Section 124 (a) of the Penal Code Chapter 63 Laws of Kenya.
They are further accussed of neglecting to prevent the escape of the suspect, a self confessed serial murder suspect – A duty that they were bound to perform under the National Police Service Act.
The offence is said to have occurred on the night of 12 and 13 October, 2021 with the suspect still st large.
The investigating officer in the application said that the suspects should they be released and allowed to go back to their stations, could possibly interfere with the investigations.
The officers further revealed that they have been left ‘handicapped’ by the incident and can not complete investigations on the suspected serial killer facing 13 counts of murder.
The office of the Director of Public Prosecutions(ODPP) had also recommended that the suspects be detained for 14 days in order to facilitate further investigations.
Shockingly Friday Morning, the suspected Serial killer, Masten Wanjala was lynched by an angry mob after it was established that he was hiding out at his parent’s Bungoma home.
He was lynched by an irate mob more than 400 kilometers from Nairobi, right in his maternal home in Kabuchai, Bungoma County Friday Morning.
Just like questions abound as to how he escaped, it is also not yet clear how he travelled to Bungoma undetected.
According to police, Wanjala was identified after he joined a football match in the area and played with locals.
Some of those who identified him as a wanted man later trailed him to his home where they lynched him.
Area Assistant County Commissioner Cornelius Nyaribai told Shahidi News that the suspect was flushed from his parent’s house and lynched by a mob.
“We don’t encourage mob lynching but we can confirm the suspect was trailed by a mob and killed,” he said.
Bungoma head of DCI Joseph Ondoro said locals had confirmed Wanjala’s identity. But he said they will take his fingerprints for further confirmation.
“We have picked his fingerprints for further clarification. But locals have identified the body,” he said Friday.
