KISII, Kenya, Oct 29- Widow to the late Kisii Public Service board chairperson has accused an administrator of excluding her from the list of family beneficiaries.
Edna Kwamboka, who was the second wife of the late Evans Mamboleo, has filed an application before Senior Principal Magistrate Caroline Ocharo.
The widow asked the court to certify the application as a matter of urgency and the case heard on a priority basis.
Kwamboka has accused Itibo location chief Robert Osoro of failing to recognize her as a beneficiary of the late Mamboleo’s estate.
Through her lawyer George Morara, she wants the chief compelled to issue a letter recognizing her as a second wife.
Morara asked the court to direct the acting chief to include Kwamboka in his letter as Mamboleo’s wife, to enable them to file a succession case and obtain letters of admission.
“We ask the court to compel the second respondent (acting area chief) to issue a joint letter of recognition to Nyaboke and the first wife to enable them file succession proceedings over the estate of Evans Mamboleo,” the lawyer said.
Meanwhile, Morara has asked the court to issue an order stopping any action by the first wife from taking letters or administration, in exclusion of Kwamboka.
The case will be heard on 2nd November 2021.
