NAIROBI, Kenya, Nov 22- The High Court on Monday ordered firebrand lawyer Miguna Miguna to obtain emergency travel documents from the Kenya High Commission in Berlin or any other place within 72 hours, for him to gain access to the country.
This is after he faced a red alert issued against airlines in Berlin, aborting his much-expected return to the country.
Judge Hedwing Ongudi also ordered Air France to allow the Canadian-based lawyer to board their flight- once he produces the emergency travel document.
According to the court order, Foreign Affairs Cabinet Secretary Raychelle Omamo is the one to ensure the orders are complied with.
The Judge ruled that the Kenyan ID Miguna is using to travel with is not a travelling document and that being a dual citizen, he is required by law to obtain a travelling Visa.
But a defiant Miguna vowed not to re-apply his Kenyan citizenship, saying he never lost it.
“I’m not visiting the Kenyan Embassy to apply for citizenship which I never lost. The Court has once more AFFIRMED that I am a Kenyan by birth who must enter Kenya as a Kenyan upon presentation of my National ID card,” he said in a Tweet.
“The Embassy has been ORDERED to issue a travel document.”
The government has always argued that Miguna lost his Kenyan citizenship when he acquired a Canadian passport.
Once in Kenya, the Judge ruled that Miguna should immediately apply for a Kenyan passport, and the same issued, to him within seven days as long as all requirements are complied with.
