NAIROBI,Kenya, Feb, 15 – Meru Senator Mithika Linturi has filed an application in court seeking to be given nude photographs and videos allegedly taken of him by witnesses at Maiyan Villas Resort in Nanyuki where he is accused of alleged rape.
Linturi through his lawyer Muthomi Thiankolu also in his application sought to be provided with O.B NO 38 abstract of Nanyuki police station dated January 30, 2021 where he had filed an extortion complain against his accuser.
The legislature argued that failure to be accorded the said documents also including witness statements would merit a dismissal of the case.
The witness statements are said to have been filed on January,31,2021.
According to Linturi, sexual assault charges leveled against him were conceived as a ploy to extort him after he filed a compliant against the complainant.
Appearing before Chief magistrate Susan Shitubi,his counsel meanwhile through written submissions argues that his client’s extortion complaint has failed to materialize with investigations being delayed.
The prosecution through Alice Mathangani has meanwhile told the court that it is yet to be supplied with the application.
The hearing of the application has now been postponed to March,16.2022.
Linturi Alleged Rape. What Happened?
According to court documents, Linturi is alleged to have attempted to rape a 36 year old woman while at Maiyan Villas Hotel in Nanyuki town.
The incident allegedly occurred at 3am on January 30,2021.
The victim told police that on the fateful day, she heard a knock on the door of her hotel room and proceeded to open it….assuming that it was her husband, the accused allegedly retired to bed with her. She uncomfortably noticed the person inappropriately touching her.
Nearly 30 minutes later, she realized that the man in her bed was not her husband, according to police reports. As her real husband burst into the room.
Friends at the hotel later raised an alarm and identified the suspect as senator Linturi.
The legislator is alleged to have mistaken his room which is said to have been adjacent to that of the victim.
Linturi as ice pleaded not guilty to the charges.
The accused was also charged with a second count of committing an indecent act contrary to section 11 (a) of the Sexual Offenses Act.
He also pleaded not guilty to the second charge.
