NAIROBI,Kenya, Feb, 16 – Court proceedings in the case where a man was accused of pushing his 20 year-old girlfriend from the 12th floor to the 9th floor at Ambank house kicked off in earnest with the investigating officer Cosmus Kaloki during cross examination revealing that there were no witnesses nor footage obtained from CCTV cameras to depict what transpired on the fateful day.
The incident occurred on 13,9,2020.
The officer is said to have questioned night guards at the premises.
“The witnesses who were night guards stated that they were informed by the accused person that the complainant had jumped out of the office and the office was not fitted with CCTV camera “Kaloki told the court.
Appearing before Senior Principal Magistrate Esther Kimilu the court was informed that the victim,Eunice Wangari Wakimbi had met the accused, Moses Gatama Njoroge via Facebook and later established close relations.
“The victim had been admitted at KNH following the incident,i summoned the witnesses and recorded their statement and also visited the scene of crime” he added.
Wakimbi is said to have left her rural home in Karura,Kiambu county and travelled to Nairobi to meet Njoroge.
They met at his office at Ambank situated on the 12th floor.
They had first gone for lunch at a city hotel and later bought whiskey and a soda at a city supermarket before heading to the accused’s office.
Preliminary reports filed at the Central police station, revealed that they took alcohol until 7pm.
The victim is then said to have requested to leave at around 7.30pm.
Two conflicting reports, first by the victim stated that she requested to leave while the accused claims that they both agreed to leave together and head to the bus terminus.
It was at this point the accused claims the victim jumped out of the window before landing on the 9th floor.
The investigating officer however told the court that according to investigations the accused restrained the victim from leaving before an argument ensued.
The investigating officer further stated that the accused could have prevented the incident based on the medical report and testimonies by the victim.
Wakimbi while testifying said the accused had made sexual advances towards her before she refused his attempts.
This is allegedly said to have angered him.
She was quickly rushed to the Kenyatta National Hospital (KNH) and is currently using crutches to walk.
The prosecution closed their case as the court ordered both parties to file written submissions before a ruling on case.
