NAIROBI, Kenya, Mar 31-Suna East Member of Parliament Junet Mohammed says the Thursday’s judgement on a petition challenging the Building Bridges Initiative affirms, “our belief in the rule of law and constitutionalism.”
Mohammed alongside former Dagoretti South legislator Dennis Waweru co-chaired the taskforce that oversaw the process of collecting views and signatures from Kenyans.
But the constitutional amendment process was brought to a halt by the Supreme Court, for being unconstitutionally initiated.
Majority of the 7-judge bench said the President role made the process not be a popular initiative, as required by the law.
“The President cannot run with hares and hunt with the hounds,” Supreme Court Judge William Ouko elaborated as he rendered his opinion on Thursday.
Justice Ouko affirmed the popular initiative is limited to the general public, dismissing arguments by BBI proponents who presented Waweru and Junet as the promoters of the constitutional amendment Bill invalidated by both the Constitutional Court and Court of Appeal.
Former Vice President Kalonzo Musyoka simply said, “We respect the Supreme Court.”
