NAIROBI,Kenya, Apr, 1 – Twin brothers, Paul and Edward Ndichu are yet again on the wrong side of the law after they failed to honour orders to appear in court amidst their assault case.
The brothers are accused of assaulting Stephanie and Cheryl Murgor at Ole Sereni Hotel in Nairobi last year. The incident was captured by CCTV cameras.
The office of the Director Of Public Prosecutions (ODPP) sought orders to have them arrested after failing to appear in court -Their application was accepted by Kibera Chief Magistrate Ann Mwangi.
“Since the two accused persons are not in court despite a court order, I therefore issue a warrant of arrest against them. They should be produced in court immediately,” Mwangi ordered.
The victim’s lawyer Philip Murgor, welcomed the move saying the accused had taken the judiciary for granted.
Their assault case was set to be mentioned this week, where Edward was also expected to plead to the assault charges.
His brother Paul had already been charged with assault and malicious damage. He pleaded not guilty and was released on a Sh100,00 bond or a cash bail of a similar amount.
At the time Edward said that he failed to appear in court after contracting COVID-19.
Earlier on, the twin brothers sought the suspension of the prosecution arguing that their arraignment was illegal and that the DPP had abused his powers and wasted the court’s time.
They also argued that the DPP was malicious by charging them separately yet they are accused of allegedly committing the assault jointly. The Ndichu twins further complained that they were not given the chance to properly defend their actions as to what exactly led to the unfortunate incident.
judge Hedwig Ong’udi declined to issue the orders sought while recalling their file.
He also set a date for a motion of the application where further directions were set to be issued on March, 28,2022.
