NAIROBI, Kenya, Jul, 21 – Patrick Macharia Magu, a matatu driver accused of reckless driving, resulting in the death of deputy inspector general of police Edward Mbugua’s daughter Nelly Waithera, has been sentenced to three years and eight months in jail or pay a fine of Sh200,000.
The incident occurred on June 17, 2021.
Appearing before Nairobi senior principal magistrate Esther Kimilu, the accused was found guilty of causing death by dangerous driving.
As part of the ruling, the accused also saw his driving license suspended for one year as the magistrate also said that the vehicle was unroadworthy.
During the course of the car, the court was shown CCTV footage of the tragic incident.
It was part of exhibits presented by Police Constable Peter Ndirangu from the Central Police Station Nairobi at the time.
Ndirangu took the court through the series of events including the deceased’s last moments. The incident took place at the Junction Tom Mboya Street and Maranga Lane in Nairobi.
“The City Shuttle Bus driver is seen reversing the public service vehicle without due care. The victim of the accident was sandwiched between the two PSV vehicles KBR 065B (driven by Magu) and KBL 744L which was stationary,” said Ndirangu while pointing to the incident on a screen in court.
Magu was positively identified to be the perpetrator.
The deceased is said to have lost her life enroute to the Kenyatta National Hospital (KNH). She succumbed to her injuries.
The accused is meanwhile said to have abandoned his vehicle upon realizing what he did. He was arrested shortly after.
