    Supreme Decision: Judges To Deliver Judgement On Presidential Petition On Monday

    NAIROBI, Kenya, Sept, 3 – It was deemed as a do-or-die legal battle by lawyers representing Azimio La Umoja-One Kenya Alliance presidential candidate Raila Odinga and United Democratic Alliance’s William Ruto as the Supreme Court kicked off a near one week hearing on the presidential election petition case.

    On Friday, the Apex court concluded proceedings amid the end of legal submissions as it retreated for the weekend where judges are expected to write up and deliver their judgment on Monday.

    The seven Judge bench is expected to deliberate on the petition, further accessing the evidence presented by both sides in court.

    “We will deliver our judgments on Monday 5th. We shall give you notice closer to that day indicating the exact time when that will be done,” said CJ Koome.

    As the main petitioner, lawyers representing Azimio responded to the submissions of opposing counsels that were made on Friday, further urging the court to nullify the presidential election results particularly after the Registrar’s office released a report upon its scrutiny of the Independent Electoral and Boundaries Commission (IEBC) servers on the polls.

    Ballots from 15 polling stations had been identified and ordered to undergo a recount under the supervision of court officers.

    The judges meanwhile hailed lawyers for adhering to the rules of the court and making their submissions in accordance with court protocols and carrying themselves out with decorum.

    No lawyer was cited to be in contempt during the period of the case.

    “We ask that you continue to pray for us so that we can render a judgment that promotes our Constitution that is anchored in law and that nurtures our democracy and brings harmony to our country,” said Justice Philomena Mwilu.

    IEBC Presidential Election Results

    Chebukati said that Ruto garnered 7,176,141 votes representing  50.49 per cent of the total votes cast nationwide.

    “He achieved the minimum number of 39 counties at 25 per cent,” he said.

    “In accordance with the constitution and the law, I Wafula Chebukati, Chairperson of the IEBC, hereby declare that Ruto William Samoei has been duly elected as the president of the Republic of Kenya under the provisions of article 138 of the constitution in the presidential election held on August 9, 2022,”

    Azimio La Umoja-One Kenya Alliance presidential candidate Raila Odinga emerged second in the race garnering, 6,942,930 votes. This represents 48.85 per cent of the total votes cast.

    Other candidates in the race included Roots Party’s George Wajackoyah who garnered 61,969 representing 0.44 per cent of the total votes cast. He came in third in the race.
