NAIROBI, Kenya, Sept, 22 – Appearing before the Anti-Corruption court, Deputy Director of Public Prosecutions Alexander Muteti has cited massive interference of witnesses in the Sh63 billion fraud case pertaining to the Arror and Kimwaer Dam scandal.

Former Finance Cabinet Secretary Henry Rotich is facing charges of Fraud in the matter.

“I have confirmed from the Director of Public Prosecutions that there is an active matter which is under investigation for the interference of witnesses concerning this case. We have prosecuted matters before but I say this with a heavy heart that this is a difficult process,” said Muteti.

Muteti told Chief Magistrate Lawrence Mugambi that prosecuting the corruption case against the had become a heavy task.

The defense team has been accused of interfering with witnesses by allegedly attempting to persuade them not to testify in court.

Counsel representing the former embattled CS, Kioko Kilukumi, had objected to a witness being brought to the stand to testify saying that the court had already issued pretrial guidelines on the sequence of when each witness will be called and the documents to be relied on.

Kilukumi further argued that the witness in question is not the second witness to testify but rather the 28 on the list of witnesses.

He further accused the ODPP of notifying him of their intention to have the witness testify on Wednesday evening and that documents from the prosecution arrived in their email in the morning making it impossible for them to review them.

The Court has since called on the ODPP to get its affairs in order regarding the matter after an application seeking an adjournment of the case.

Meanwhile after the witness set to be put on the stand said he was not ready to testify, the case has since been adjourned to November,18,2022.
