MALINDI, Kenya, Dec 22- The Family of Ngumbao Jola who was shot dead during a scuffle involving Gender and Public Service Cabinet Secretary Aisha Jumwa, who was then Malindi MP, has withdrawn from the murder case.
The family says the decision was reached at after the High Court in Mombasa cleared Jumwa as the key suspect in the matter.
The Director of Public Prosecution withdrew charges against Jumwa, leaving her bodyguard who was her co-accused Geoffery Okuto to face trial over the murder, with Jumwa testifying against him.
Jola’s family members gathered at his gravesite where they conducted prayers before making the announcement they will not part of the case after the main suspect was set free.
During the briefing to the media, Jola’s parents broke down saying they are still hurting by the cold-blood murder of their son.
He was killed during the Ganda Ward by-election when Jumwa and her supporters stormed the home claiming there was an unlawful meeting taking place there as the campaign period was over.
Rodgers Katana Jola, a family member, said that they are still mourning the death of Jola and are sad because he was killed at home and the government took action by arresting Jumwa.
He said they are now surprised that the same government has withdrawn the murder charges against Jumwa, which he termed an injustice to them.
“We are mourning with bitterness because of the death and if there is God in heaven we leave it to him,” he said.
Jola’s mother who could only speak in the Giriama dialect could not hold back her tears as she broke down while narrating the manner in which the case was going on.
“I have heard that she has been set free and charges withdrawn if it’s real justice let her be free but if it’s not God will give his judgment,” she said.
Alfred Jola, brother of the deceased, said the government initially did its investigations well when the case started and even DPP Nordin Haji found out that Jumwa was the main suspect in the case.
Surprisingly he said the regime of Kenya Kwanza Government has now suddenly found out that she is innocent.
“Why should she be a witness in front of us if she was a suspect who was charged, that issue really hurts me, she is the one who invaded our home and caused all the problems, now she is a witness of Geoffery Okuto how?” he posed.
Jola said God is the one who will judge that case and that since Jumwa’s charges were withdrawn, Okuto should also be set free.
Reuben Katana the deceased uncle said they were shocked to hear that the key suspect in the murder case of Ngumbao Jola had been set free and made to be a witness in the case.
As a family, he said they knew the CS was the one who caused the death of Jola since it was her who took Okuto to their home.
“As a family since we are poor, we have nothing, we don’t even have a village elder in our home we are even fearing for our safety because the key suspect is senior in the government, she has money,” he said.
Katana a former Ganda MCA said they resolved as a family to leave the case to God to make the judgement,
He said they have written a letter to the DPP through their lawyer which will reach him any time stating that they have withdrawn from the case.
Katana said as a family they do not want to proceed with the case because they fear for their safety.
