NAIROBI, Kenya, Jan 18 – Two employees of the Nairobi Metropolitan Services who were charged with stealing a baby from the Mama Lucy Kibaki hospital have a case to answer, Milimani Law Courts Principal Magistrate Esther Kimilu has said.
Makallah Fred Leparan and Selina Awuor Adundo are accused of stealing three infants aged 8 days, 2 weeks and 2 months respectively from the hospital on diverse dates between March and November 2020. The three infants were aged:
The Magistrate said that the prosecution had proven the case beyond reasonable doubt that the two knowingly caused the three infants to be in need of care and protection by failing to protect them despite their position.
The two are expected to take to the stand on March 7, 2023, to prove their innocence before the Magistrate goes to write her judgement.
Mr Leparan told the court that he will give unsworn evidence while his co-accused Awuor said that she will give sworn evidence.
The two were taken to court after BBC aired an investigative piece in which the two were caught on camera receiving money and aiding the TV undercover team to purchase babies from the hospital.
Some of the BBC reporters are the key witnesses in the case.
