KISII Kenya August 10 -Former Kisii boda boda association chairman Fred Nunda has been arrested in connection to the murder of a boda boda rider during a clash between rival groups on May 16.
Nunda was on Thursday August 10 arraigned before Kisii Law Courts on a miscellaneous application.
In his application, the prosecution counsel James Morande said the suspect was arrested on Wednesday at Ekerenyo in Nyamira by the Directorate of Criminal Investigations (DCI) detectives.
The prosecution asked the court to remand the accused person at Kisii Main Prisons awaiting mental assessment.
“I am asking this court to remand the suspect at GK Main prisons as he waits for mental assessment at Kisii Teaching and Referral hospital,” Morande said.
He added that the accused person was a resident of Kisii who resides at Gesonso in Kisii South and commands a large group of boda boda riders who were likely to storm Central police station should he be remanded there.
“Remanding the suspect at GK main prisons will be good for his safety,” Morande said.
Nunda’s lawyer and former LSK chairman Wilkins Ochoki objected the application of detaining his client at GK prisons and said he is a resident of Kisii and he is not the only boda boda chairman, there are over 300 boda boda chairmen in the country and being a chairman doesn’t mean the court should go against the Constitution.
“If police are fearing chaos in the police station clearly shows police officers are not keen on the their job; they should ensure there’s peace and order,” said Ochoki.
In her ruling, magistrate Dorcas Mac’andere ordered the suspect to be remanded at Kisii main prisons and that he will appear in court on August 14 for plea taking.
