Former Kiambu governor Ferdinand Waititu and his wife Susan Wangari have been found guilty in the Sh588 million road tender graft case.
Anti-corruption chief magistrate Thomas Nzyoki ruled on Thursday that the prosecution had established a prima facie case against Waititu, Wangari and 11 other accused persons.
“Having considered the evidence on record and the submissions made by all parties in terms of section 306 of the Criminal Procedure Code (CPC), I am satisfied that the State has established a prima facie case against the accused persons on counts 1, 2, 3, 4, 5, 7, 8, 9, 10, 11 and 12,” Nzyoki ruled.
He said the evidence presented by the prosecution through 32 witnesses and 741 exhibits was overwhelming to allow them to defend themselves.
Waititu had tried to stop the trial by filing an application to quash the charges against him, his wife and the other co-accused.
He argued that the charge sheet did not specify the exact charges against them.
The case accused the suspects of fraudulently benefiting from tenders worth Sh588 million.
Investigators from the Ethics and Anti-Corruption Commission (EACC) alleged that the lucrative tender was awarded to a company linked to the governor’s deputies.
