Fugitive who was rearrested on February 13 will only have access to his defence counsel
Fugitive Kevin Kinyanjui Kangethe who escaped from custody and rearrested on Tuesday February 13 in Ngong will be detained at Industrial Area Remand Prison.
Milimani Chief Magistrate Lucas Onyina on Wednesday allowed an application by the prosecution seeking to have the fugitive remanded at the facility pending the hearing and determination of an extradition proceeding against him.
The prosecution through Senior Assistant Director of Public Prosecutions (SADPP) Vincent Monda had also sought the court to issue orders that would ensure that the fugitive only had access to defense counsels on record for the respondent.
In case the fugitive required medical attention, the prosecution sought to have it done in consultation with the government doctor attached to the Industrial Area Remand Prison.
However, the court declined to issue orders in regard to the two prosecutions’ pleas.
The application comes after the fugitive was rearrested after escaping from Muthaiga Police Station on February 7. He was being held awaiting extradition to the United States to answer to a charge of first degree murder.
The escape happened after a person who identified himself as a fugitive’s personal advocate was allowed to meet him.
The matter will be mentioned on February 19, 2024
