MACHAKOS,Kenya, May 28 – Two key witnesses in the murder case of slain Makueni based advocate Onesmus Masaku testified Friday at the Machakos Law Courts.
Masaku was on October, 7, 2020, allegedly assaulted by his ex-lover, police constable Nancy Njeri at his home in Wote, Makueni county.
The accused, Njeri, during the altercation that turned tragic, is said to have lashed out at Masaku and then swung a machete at him, chopping off his hand.
Masaku was rushed to the Makueni Referral Hospital and then to the Kenyatta National Hospital (KNH) where he succumbed to his injuries shortly upon arrival.
During the first witness testimony, Joshua Musyoka, the deceased’s neighbour, took to the stands and narrated to the courts the tragic events leading to that fateful night.
Musyoka lived adjacent to Masaku’s house.
“When I was there I heard noises coming from my neighbour’s house (Masaku), he was saying I am dying, please help me. I quickly turned off my TV in order to confirm what I had just heard. Shortly after, I heard neighbours walking outside, then I opened the door to see what was happening, I saw Masaku’s door was open.” Said Musyoka.
Musyoka further told the courts that blood was spattered all over his wall, and on the floor by the door.
Other neighbours shortly after came to the scene.
“I then heard Masaku shouting on the verandah near the balcony. I asked him what is happening Masaku and when he heard my voice, he screamed Joshua save me, I am dying. He then tried to lift himself up and hold on to me but I could not touch him since he had blood all over. ”
Musyoka told the courts that he told him to stay put as he sought for a way to help him.
More Neighbours shortly after arrived at the scene as Musyoka called the ambulance in an attempt to save his life.
The deceased’s home, a two bedroom apartment was on the second floor of the complex, the court was told.
The court then called to the stand, the second witness, Peter Lugogo.
Lugogo painted a graphic image to the court saying that the deceased at one point crawled to the door, his arm hanging and bleeding profusely after being hacked with a machete.
“He kept on saying please help me but when he saw the large crowd outside near the staircase, he crawled back inside the house and went to the balcony. I was very shocked.” Said Lugogo.
The court was then informed that as the deceased was crawling out of his home, another person, a female, also attempted to follow him only to return back inside when she saw the crowd.
The woman in question was positively identified in the court room by Lugogo as the accused, constable Njeri.
“When she saw there was a crowd, she went and took her bag and attempted to leave but the caretaker who was also there went and closed the gate. When I recovered from the shock, that is when I called my brother who is a doctor and tried to explain to him what had happened. ”
The second witness, Lugogo then told the court his brother told him not to leave the scene as he had left his medical kit bag as he waited for police to arrive at the scene.
The deceased was shortly after rushed to the Makueni Referral Hospital.
“One person who I was told was the OCS came, went into the house and took the panga which was in the house and left. However before they left, the lady (accussed) said she had a bag and the caretaker produced it from where he had hidden it.”
The prosecution,Andrew Makundi, meanwhile asked Lugogo whether he could identify the woman, upon which he said, “she is there, we don’t know each other , though I have been her before on the streets of Wote,” Said peter Lugogo.
Justice David Kemei ruled that the matter was rescheduled to October, 6, 2021 for further hearing.
Over 10 advocates including the president of the Law Society of Kenya (LSK) Nelson Havi and deputy LSK president Caroline Kamende are representing the deceased.
