KIAMBU,Kenya, Jan, 27 – The move by the judiciary to establish two small claims court in Thika has been hailed by the residents as a step in the right direction amidst the increasing backlog of cases within the jurisdiction.
Hundreds of the cases are said to have been pending within the the area for years leaving residents wasting time and resources within the corridors of justice.
While unveiling the courts, registrar in charge of small claims court Stella Kanyiri said that the courts will seek to resolve civil and commercial disputes with relatively small claims of up to Sh1,000,000.
The judicial Service Commission is now expected to appoint an adjudicator to hear cases in the subordinate court in a period of less than two months.
Cases to be heard at the small courts are contracts for sale and supply of goods and services, contracts relating to money held and received and compensation for personal injuries and set-off and counterclaim under any contract.
Meanwhile Thika Law Court Chief Magistrate Stella Atambo urged residents to take advantage of the small claims court by filling their disputes.
Adjudicators are expected to employ appropriate mechanisms to ensure expeditious disposal of suits.
