BARINGO,Kenya, Feb, 3 – East Africa Legislative Assembly (EALA) MP Florence Jematia will spend another night in police custody before being arraigned Friday as the court rules on an application by detectives to detain her for a further five days.
The prosecution had sought more time to hold her in order to allow detectives conclude their investigations.
She is alleged to have evaded arrest and defied summons before finally being arrested by sleuths in Nairobi.
Appearing before Kabarnet Law Courts Resident Magistrate Nerolyne Idagwa,the EALA MP is said to have uttered reckless, incendiary and divisive comments calling on residents to raise funds in order to purchase firearms.
Her remarks are said to be tantamount to incitement to violence.
She is said to have made the remarks during a public meeting in Mochongoi, on Sunday,January, 30,2022.
In the now viral video, the legislature is seen inciting the residents and saying that the government had failed to protect residents. She is further seen mobilising for the creation of a paybill number to raise the required funds.
“We cannot continue holding peace meetings over the years without a formidable solution, yet women and children spend the night in the bushes due to displacement. We have lost more than enough people in the war-torn area and this should be stopped,” said Jematia.
“We need a paybill number now to collect funds to purchase guns. If people can afford motorcycles, then they can afford the arms as well. Local leaders should also allocate funds to the same to solve this menace if the government is (reluctant) to hear our cries,” she said.
Meanwhile the suspect’s lawyer sought her release saying that the legislator needed treatment for ulcers at a Private Hospital in Kabarnet town.
The prosecution is preferring charges of uttering words with subversive intention contrary to section 77 of the penal code against her.
Her counsel meanwhile argued that Jematia was misquoted and that she was referring to the purchase of legal and licensed firearms.
