    Police Officer Accused Of Assaulting Man For ‘Blocking His Way’ Arrested

    NAIROBI, Kenya, Feb 18- A Police Constable who seriously assaulted a man he claimed blocked his way along Jogoo Road in September 2020 has been arrested.

    Constable Evans Kemboi is expected to be charged at the Milimani Law Courts this morning for assaulting Nickson Gitau.

    The Internal Affairs Unit (IAU) officers arrested the officer after the ODPP approved charges of assault and malicious damage to property against him.

    The investigators said on September 25, 2020, at around 10 pm, Gitau while in the company of his friends heading home, was confronted by the officer along Jogoo Road in the middle of the traffic jam for blocking his way.

    Gitau on sensing danger, ran and sought refuge at Jogoo Police station but the officer pursued him at attacked him at the Station in front of other officers.

    “The victim cried for help but even the senior officers at the station did not intervene,” police said.

    The officer went further and destroyed Gitau’s car.

    The IAU Investigated the matter after Gitau filed a complaint in June last year.

    “Pursuant to its mandate as stipulated under NPS Act and other relevant laws, the Unit undertook the matter and on completion submitted findings and recommendations to Inspector General that the officer be criminally held liable for assaulting a member of Public,” the IAU wrote. 

    The investigation file was then forwarded to ODPP for perusal and guidance.

    The ODPP gave consent and further directed that the two senior officers who were at the station during the attack be dealt with by the Inspector General of police for being negligent in their performance of duties.

    The officer committed the offence while he was based at Industrial Area Police Station traffic department.

    After the incident, he was transferred to Spring Valley then to Kayole before being transferred to Spring Valley again, within a span of one year.

    The officer was on Thursday charged in court. He was released on Sh15,000 cash bail.

    He appeared before Milimani Chief Magistrate Susan Shitubi.

    The case is set for a pre-trial hearing on March 3, 2022.
