NAIROBI,Kenya, Mar, 29 – Yahya Abdi Mohammed, a city developer has been slapped with a Sh500,000 fine for failing to erect buffers at a construction site in contravention to the National Environmental Management Authority (NEMA) regulations.
In contravention to the license, the accused in default will serve a two year jail sentence.
Appearing before Resident Magistrate William Tullel at the Kibera law courts, the accused pleaded guilty for breaching terms of a license contrary to environmental impact assessment audit.
His construction license was issue to him on September 15, 2021 for a construction project along Ole Shapara road in South C, Nairobi on March 22.
The court also ruled that he defied the terms of the contractor not to undertake construction work past 5pm.
According to court documents, on the fateful day, the NEMA inspection officers are said to have found workers at the site past 6pm.
inspector Koiyet Shieni and a team of police officers attached to NEMA arrived at the site responding to an incident reported to NEMA by members of public living near the construction site.
The accused was shortly after summoned and presented documents showing he was incharge of the site. He then presented the relevant licenses.
According to nema he had failed to erect a signanage as per the Ministry of Transport and infrastructure standards indicating the NEMA reference number.
He also failed to ensure buffers – hoarding and duct screen are installed to protect members of the public from falling objects and failing to ensure construction activities are undertaken during the day between 8am and 5pm.
Mohammed was shortly after arrested after it was established he breached terms of the license.
Others before the court were also charged.
