MOMBASA, Kenya, Dec 21 – The High Court in Mombasa has formally allowed an application by the Office of the Director of Public Prosecutions (ODPP) Noordin Haji to withdraw murder charges against Gender and Public Service Cabinet Secretary Aisha Jumwa.
Mombasa High Court Judge Ann Onginjo quashed the proceedings against Jumwa on Wednesday, December 21, which now makes her a state witness against her bodyguard Geoffrey Otieno Okuto.
The DPP made the application in November virtually during the mention of the case but Justice Onginjo directed him to appear in person and give detailed reasons for his decision.
She was quick to caution Jumwa that the discharge does not fully exonerate her from the crime.
Jumwa and Okuto were charged with the murder of an ODM supporter Jola Ngumbao in Malindi when a fight broke out during the campaigns for Ganda ward by-election.
After the termination of Jumwa charges, Okuto was charged afresh with the crime, which he has since denied.
